This website is operated by DesignersPivot LLC. Throughout the site, the terms “we”, “us” and “our” refer to DesignersPivot LLC. DesignersPivot offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including Privacy Policy), and procedures that may be published from time to time on this Site by DesignersPivot LLC (collectively, the “Agreement”). By visiting our site and/ or purchasing/ selling something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein

If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. DesignersPivot LLC considers these terms and conditions as an offer and acceptance expressly limited to these terms. The Website is available only to individuals who are at least 21 years old or are accessing the Site and its services under the supervision of a parent or legal guardian. Designers Pivot will not be liable for any indirect, incidental, or punitive damages arising from the use of this site or from any agreement with Designers Pivot LLC.

The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards of operating countries laws. Therefore, the Customers and sellers are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted.

We reserve the right to remove any product from this website at any time. Although we will always do everything possible to process all orders, there may be exceptional circumstances that force us to refuse to process an order after having sent the Order Confirmation. We reserve the right to do so at any time. We shall not be liable to you or to any third party for removing any product from this website, or for removing or modifying any material or content from the website or not processing an order once we have sent the Order Confirmation.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

By placing an order with us you accept receiving sms/email/WhatsApp regarding your order tracking status.

We act as a trusted third party between our buyers and sellers in order to guarantee sales, payment, delivery time and, when applicable, product returns. With a strong authentication process for high-end and luxury goods, we are making it a priority to fight against counterfeiting.

Please note that International Buyers are liable for any import duties and taxes.
Please note that products bought with "tabby" or "Cashew" installment option are not eligible for returns, refunds or exchanges.

Designers Pivot LLC is partnered up with UNICEF, Emirates Red Crescent and Andrea Bocelli Foundation to help needy communities. Please note all donations made are final and non refundable. Designers Pivot LLC displays all receipts of donations on designerspivot Instagram and Website.

Description of Services

In the site, www.designerspivot.com, we provide users with access to pre-owned luxury goods through buy and sell process.

Trademarks

The trademarks, logos and service marks (“Marks”) displayed on the Site are the property of DesignersPivot. Users are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or sites on the World Wide Web without the written permission of DesignersPivot or such third party which may own the Marks. Any trademark use that is unauthorized by the DesignersPivot will be deemed as trademark infringement and will be penalized by the UAE Laws.
DesignersPivot is not associated with the brands that it sells, which are a registered trademarks of the respective brand owners and not of DesignersPivot.

Buying Terms

This section constitutes a binding agreement between User (hereafter within these Buying Terms “Buyer”) and DesignersPivot. DesignersPivot is in no way associated with the brands that it sells.

Buyer acknowledges that DesignersPivot authentication process is in-house and independent of any brand association of any kind or nature.
Brands mentioned on the Site are not involved in the authentication of items being sold and none of the brands assumes or own any responsibility for any item purchased through the Site.

The Buyer must pay the Price, displayed selling price that includes the seller cost in addition to DesignersPivot commission “Authentication Costs, the Carriage Costs and any other applicable costs” via the secure payment system of DesignersPivot, by bank card, VISA card, Mastercard, American Express card, or through installment when applicable.

In case of pre order for specific item with deposit, if customer decide to not pursue with the sale, the deposit is lost and remains with DesignersPivot.

The Buyer is advised to request detailed video/ zoom call/ viewing in person to assess item’s condition before purchasing it. In the event neither of it is done, the Buyer herein agrees and has no objection with the condition of the item being sold. Designers Pivot ensures that all information, photos, videos are reflecting item’s true condition. Therefore the only reason for return or refund is if the item in question is deemed non authentic or the wrong product is delivered.

Buyer shall not claim any compensation for any reason as per this agreement.

The Buyer should note that any item displayed with “Extended fulfillment timescale tab” has extended fulfillment timescale. The Buyer is advised to get in touch with DesignersPivot team to confirm delivery timescale.

All product orders are subject to availability and in this regard, if there are difficulties regarding the supply of products or are no more items left in stock, we reserve the right to provide you with information on substitute products of the same or higher value that you may order. If you do not wish to order the substitute products, we will reimburse any amount that you may have paid minus payment processing fee of 5%.

For pre- order and other items, we advise clients to double check current market price with our team before online payment in order to avoid payment processing fee in case of refund request.

Selling Terms

Within the scope of the online intermediation service performed by Designers Pivot LLC, the Seller hereby grants Designers Pivot a mandate to do the following:
1- To publish on the Web Site the Product Page that constitutes an offer to sell a Product, including all the content included by the Seller, and where applicable, to make changes to the photographs of the Product, to the extent of removing their background and enhancing their quality.
2- To accept the order placed by the Buyer, for and on behalf of the Seller.
3- To open a separate account on the books of the Designers Pivot, for and on behalf of the Seller, and to credit the Price of the Product into that account.
4- To receive the money and to transfer them to the Seller, after subtracting the commission and any other sum of money due should any moneys remain outstanding between the parties, as stipulated by our T&Cs.

The Seller’s commitments and obligations

The Seller undertakes to sell only Products of which they are the sole owner, or in case of a sale on consignment of second-hand products, on behalf of a person who is the owner of the Products.

The Seller hereby represents that they are not violating the UAE laws and regulations in any way and are not infringing the rights of any third parties by submitting a Product Page to DesignersPivot or by offering a Product for sale via our Web Site.
The Seller warrants, represents and undertakes that the origin, the condition and the characteristics of the Product that they offer on Designers Pivot website comply with that description of the Product on the corresponding Product Page, and that the Product that is offered for sale is not counterfeit.

Should DesignersPivot request proof of authenticity, the Sellers must immediately provide it with all the documents proving their ownership of the Products that are offered for sale and/or the legitimate origin of these Products.
DesignersPivot shall be entitled to delete the Product Page of a Seller who fails to provide evidence of their ownership rights over the Product(s) that are offered for sale and/or of the legitimate origin of the Product(s).

The Seller shall be barred from claiming any right to compensation if DesignersPivot deletes this information for the reasons mentioned above. The seller shall be barred from claiming any compensation whatsoever.
The Seller shall be the only person responsible for the sale of a Product. The Seller shall refrain from selling any Product whose sale is prohibited or would violate the UAE Laws and regulations and/or infringe the rights of third parties.

By submitting Content to DesignersPivot, the Seller grants DesignersPivot a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting Seller’s product.

Once a Seller’s Product Page has been put online, the Seller must stay in touch with Designers Pivot regularly in order to update on availability of the product.

Should the Seller be unable to immediately ship product to DesignersPivot in the event of sale, the Seller must inform DesignersPivot and prospective buyers about an extended fulfilment timescale by contacting DesignersPivot team. The product would be displayed with “extended fulfillment timescale tab” on the website. Seller may resume the sale, upon their return.

Responsibility of Website Visitors

Designers Pivot has not reviewed, and cannot review, all the material, including computer software, posted to the Website, and cannot, be responsible for that material’s content, use or effects. By operating the Website, Designers Pivot does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful, or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying, or use of which is subject to additional terms and conditions, stated or unstated. Designers Pivot disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). Designers Pivot shall not be responsible for any damages arising from that.

You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

We have not reviewed, and cannot review, all the material, including computer software, made available through the websites and webpages to which DesignersPivot links, and that link to DesignersPivot.
